Franchise dispute lawyer: forum, ADR and what fits a dispute

Disputes go beyond termination. Where one is heard, and whether mediation or arbitration comes first, depends mostly on the agreement.

A franchise dispute lawyer handles disagreements between franchisee and franchisor that are wider than a single termination: unpaid fees, territory, renewal, transfer, trademark use, or claims about what was disclosed before the sale. Fit depends first on where the dispute would be heard, because the agreement usually decides that, and a lawyer who is not admitted or experienced in that forum may need local counsel.

Where the dispute goes

The FTC's guide says Item 17 of the disclosure document states whether you can go to court or must use arbitration. A forum-selection clause names the place. The U.S. Supreme Court has said a valid forum-selection clause should be given controlling weight 'in all but the most exceptional cases' (Atlantic Marine, 2013), though state law can differ, as with the California and Washington examples in franchisee attorney. More in forum selection clauses.

The U.S. Solicitor General, in a brief to the Supreme Court, stated that private judicial relief is not available for violations of the Franchise Rule. That is the government's litigation position, not a court holding, but it is one reason franchise disputes are mostly argued under the contract and state law.

Mediation and arbitration

Many agreements require mediation or arbitration. Mediation is an assisted negotiation; in one federal court's program, the mediator 'has no power to render a decision or require a settlement' and if there is no settlement the case stays in litigation (D.D.C. FAQs, 2018; programs differ by court). See mediation in franchise disputes.

Arbitration is a private decision. Fee figures that are published: for AAA commercial cases the initial filing fee is $1,450 for claims under $75,000 and $8,925 for claims from $1,000,000 to under $10,000,000, with arbitrator pay not included (AAA fee schedule effective Sept. 1, 2025). JAMS states a $2,500 filing fee for two-party arbitration and a 13 percent case management fee on professional fees, and says each arbitrator sets an hourly rate (JAMS fee page, undated, checked 28 October 2026). More on arbitration costs and AAA fees.

Court costs and time

Starting a federal civil case costs $405: the $350 statutory fee plus a $55 administrative fee (28 U.S.C. 1914 and the Judicial Conference fee schedule). For the 12 months to 30 June 2026, published median times from filing to disposition for civil cases ran from 3.4 to 84.4 months across the 93 districts in the U.S. Courts table, and disposition includes settlements and dismissals. Time to trial is a separate and longer row. No single national figure was found. See going to court: costs and timing.

Fees a dispute lawyer may charge

Clio's October 2026 report puts the average US lawyer rate at $362 an hour, drawn from users of its software across all practice areas; its civil litigation average is $368 and contracts $384. We found no franchise-specific hourly survey. Contracts may also shift fees: in a New York 2024 case a court found the franchisor entitled to summary judgment on liability for attorneys' fees under the franchise agreements (NGM Mgt. Group v. Bareburger Group). That result is specific to that contract and state. Read your own agreement. Cost background is in franchise termination lawyer cost.
